1. PARTIES AND ACCEPTANCE OF THE GENERAL CONDITIONS OF CONTRACT:

On the one hand, the company, PODOLOGÍA PRIEGO (from now on also the provider), with social address in Av. América nº 15 Bajo, 14800, PRIEGO DE CÓRDOBA, (Córdoba), C.I.F. 50615232Y, telephone 957540169, and e-mail: podologiapriego@gmail.com, being the owner of the web site www.podologiapriego.com, exposes the contractual document that will govern the contracting / reservation of appointment for the provision of services.

And on the other hand, the User - Client (hereinafter the User), registered in the website by means of a user name and password, over which he has full responsibility for the use and custody, being responsible for the veracity of the personal data provided to the provider.

BOTH ACCEPT this document, and implies that the user

a. Has read, understands and understands what is stated here.

b. That he/she is a person of legal age and with sufficient capacity to contract.

c. That you assume all the obligations set forth herein.

d. Who has read and accepts these general conditions of services. 

This document can be printed and stored by the Users.

The provider makes available to them the e-mail address podologiapriego@gmail.com so that they can raise any doubt about these conditions.

These conditions will be valid for an indefinite period and will be applicable to all contracts made through the provider's website.

The provider reserves the right to unilaterally modify these General Conditions, without affecting the goods or promotions that were acquired prior to the modification, in order to improve the products offered. In any case, these general conditions must be consulted before contracting the services.

It is advisable to keep a copy of the data when making the reservation of your appointment.

The civil responsibility of PODOLOGÍA PRIEGO is limited to the service of the same, the user renounces to claim any responsibility to the provider for any concept such as possible failures, slowness of access or errors in the access to the web, including losses of data or other type of information that could exist in the computer or network of the user who accesses the web.

PODOLOGIA PRIEGO is a company specialized in the treatment of pathologies associated with the foot. PODOLOGIA PRIEGO has its physical facilities at Av. América nº 15 Bajo, 14800, Priego de Córdoba, Córdoba, where it offers its services.

2. OBJECT OF THE CONTRACT:

2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship between the Provider and the User for requesting appointments for consultation that arises when the User accepts these conditions during the online application process. 

2.2 Territory of application: The www.podologiapriego.com website is active throughout Spain.

2.3 Capacity to request an appointment: To be able to make an appointment you must be of legal age.

2.4 Acceptance by the provider: Validation of an appointment through the www.podologiapriego.com website is made by replying to the user's e-mail and also implies automatic acceptance of the GCS. It is recommended on the website www.podologiapriego.com that these be made by calling the telephone number administered for this purpose 957540169. These conditions are available on the website www.podologiapriego.com or, if you wish and request it, we can make it available to you by e-mail.

2.5. Modification of the General Conditions of Contract: PODOLOGIA PRIEGO reserves the right to make changes and/or modifications to these GTC. We advise our clients to review them regularly. If these changes or modifications are made after a request has been made, the conditions in force on the date the request was made will apply.

3. INFORMATION PROVIDED ON THE WEBSITE www.podologiapriego.com:

3.1 Product information: The information contained in our advertising, brochures, other written material, on our website or provided by other users constitutes acquired trust for users. Such information does not constitute an offer to supply any product from us.

The contents of www.podologiapriego.com are constantly renewed and updated to offer our customers the most complete and detailed information possible. Due to this, it is possible that the contents may show, on exceptional occasions, provisional information about some products. In the event that the information provided does not correspond to the characteristics of the service, the customer will have the right to cancel his request.

All the contractual information on the website is shown in Spanish (Castilian) and communication with customers and users, as well as the formalisation of the contract, will be carried out in this language, although, if the customer so wishes, this can be done in another language, always indicating this before starting the application procedure.

3.2 Availability of the service(s)

As a general rule we offer all services on a continuous basis so that you do not have to wait several days or weeks to be attended to. In some specific case, due to a failure of the web or ours, it can be caused that the request does not arrive to our mail, as a general rule it is not like that, the provider does not take charge of this specific error.

3.3 Right of Cancellation:

PODOLOGIA PRIEGO reserves this action (right of cancellation of the service). 

4. APPLICATION PROCEDURE:

The user must fill out a contact form in order to request an appointment for the services offered by the provider. To do this, the user must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of current legislation on data protection, Regulation (EU) 2016/679 of 27 April 2016 (RGPD) on the protection of individuals with regard to the processing of personal data and the free movement of such data, the Organic Law 15/1999 of 13 December (LOPD) on the protection of personal data and the Royal Decree 1720/2007, developing the LOPD, detailed in the Legal Notice and Privacy Policy of this website.

The user will select a user name and a password, committing himself to make diligent use of them, and not to make them available to third parties, as well as to communicate to the provider the loss or theft of them or the possible access by an unauthorized third party, in such a way that the provider will proceed to the immediate blocking.

The user may not choose as a user name words that are intended to confuse others by identifying him/her as a member of the provider, as well as expressions that are rude, offensive and in general, contrary to the law or the requirements of morality and decency.

Once the user account has been created, we inform you that in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:

3. Once you have filled in the data, you must click on the tab "Send your message", to make the request.

5. ONLINE DISPUTE RESOLUTION

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER, without the need to resort to the courts of law, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and/or impose a solution to the conflict. 6. NULLITY AND INEFFECTIVENESS OF THE CLAUSES

If any clause included in these General Conditions were to be declared, totally or partially, null and void or ineffective, such nullity or ineffectiveness would affect only that provision or the part of it that is null and void or ineffective, with the General Conditions subsisting in all other respects, with such provision, or the part of it that is affected, being deemed not to have been made.

7. APPLICABLE LAW AND JURISDICTION:

These conditions shall be governed by or construed in accordance with Spanish law insofar as it is not expressly established. The provider and the user agree to submit any controversy which might arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals of the city of Priego de Córdoba, Córdoba (Spain).

If the user resides outside Spain, the provider and the user expressly renounce any other jurisdiction and submit to the Courts and Tribunals of the city of Priego de Córdoba, Córdoba (Spain).
